Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

on which you or a third party designated by you, who is not the carrier, have/has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered together;
on which you or a third party designated by you, who is not the carrier, have/has taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
on which you or a third party designated by you, who is not the carrier, have/has taken possession of the last partial shipment or the last item, provided that you have ordered goods that are delivered in several partial shipments or items;
on which you or a third party designated by you, who is not the carrier, have/has taken possession of the first goods, provided that goods are delivered regularly over a specified period of time as part of an order.

To exercise your right of withdrawal, you must inform us (Kombuchery GmbH, Torstraße 105–107, 10119 Berlin, Germany, email address: imprint@kombuchery.de) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

You may also exercise your right of withdrawal online via an appropriately designated button (“Withdraw from contract” or similar designation) on our website (www.kombuchery.de). If you use this online function, we will immediately send you an acknowledgement of receipt on a durable medium (e.g. by email), containing information on the content of the withdrawal declaration as well as the date and time of its receipt.

You may also electronically complete and submit the model withdrawal form or another unequivocal statement on our website (www.kombuchery.de). If you make use of this option, we will immediately send you confirmation (e.g. by email) that we have received your withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period has expired.

Please do not send returns to our office address, but exclusively to the return address specified in the return form or order confirmation.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts

for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive or which are clearly tailored to the consumer’s personal needs;
for the supply of goods that are liable to deteriorate or expire rapidly;
for the supply of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no control;
for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
for the supply of food packaging units (e.g. 6-bottle trays) that are sold exclusively as a closed sales unit and are not intended for individual sale, if, after opening or removing the outer packaging, a return is no longer reasonable for hygiene, labeling-law or product-specific reasons, in particular because the legally required mandatory information is provided exclusively on the outer packaging.

General Information

Please avoid damaging or contaminating the goods. Please return the goods, where possible, in their original packaging with all accessories and all packaging components. If necessary, please use protective outer packaging.

If you no longer have the original packaging, please ensure that suitable packaging is used to prevent transport damage.

Please do not return the goods carriage forward.

Please note that the above points are not a prerequisite for the effective exercise of the right of withdrawal.
